TERMS
This website is owned and operated by Pancake Pleasures. Throughout the site, the terms “we”, “us” and “our” refer to Pancake Pleasures. By accessing, browsing/using or making a purchase on this website, you agree to the conditions and terms stated.
Pancake Pleasures reserves the right to review and change any of the Terms by updating this page at its sole discretion. Any changes to the Terms take immediate effect from the date of their publication.
It is critical that these terms & conditions are read and understood before placing your order with Pancake Pleasures.
ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
CHANGES TO ORDERS
Pancake Pleasures will accept any changes to addresses, delivery dates, messages, and products, if Pancake Pleasures is provided with 12 hours notice via email (info@pancakepleasures.com.au), prior to the delivery/pickup date scheduled.
If 12 hours notice is not provided, Pancake Pleasures reserves the right to refuse any change requests. Whilst on route to delivery, no changes can be made to any of the order information.
If on the day of delivery, we are supplied with incorrect shipping information or the customer wishes to make any changes, the order will not be delivered on the same day the change is made and will be sent out on the following delivery date. If in any case, the customer does not want a redelivery, the customer will receive no refund to their order.
CANCELLATIONS AND REFUNDS
Orders can be cancelled, and a full refund will be issued, if Pancake Pleasures is provided with 48 hours notice via email (info@pancakepelasures.com.au), prior to the delivery/pickup date scheduled.
If an order is requested to be cancelled within the 24 hour period, we are happy to offer a full credit note to use within 12 months. The customer will receive the full refund less the fee.
Orders CANNOT be cancelled less than 24 hours prior to delivery/pickup or during the delivery.
When a refund has been processed, it may take between 1-10 business days for the money to successfully process into your account.
DELIVERY
Pancake Pleasures delivers to approximately a 25km radius from our location. Some suburbs are excluded from our delivery radius from our kitchen.
Pancake Pleasures offers a delivery fee starting at $19, payable in addition to the cost of your products and is charged at check-out.
Deliveries regularly take place between Tuesday to Sunday at 11am to 5pm on the day selected. Delivery may be outside these hours as this is just a general guideline for expected delivery times. We are unable to specify an exact time for delivery as all delivery drivers must follow a specific route to deliver all pancakes by the times listed above. We are unable to prioritise any delivery addresses under any circumstances.
Whilst every effort is made to adhere to the above delivery schedule, we use both internal and external couriers for all our deliveries, and occasionally situations arise which are out of our control resulting in delays to the time frames listed above.
We cannot accept responsibility for these unfortunate events but assure you that every effort is made to ensure your order arrives on time and in perfect condition.
No refunds will be made if your order is delivered outside of these delivery times as they are simply a guide.
If no one is present at the location of delivery, the order will be placed in a safe place, and a photo of the delivered package would be taken and sent to the customer. Please note, we will not be responsible for any ‘melted’ or ‘infested’ products as it is the customers responsibility to attend to the pancakes within the time listed above.
If there is nowhere safe to leave the pancakes or the driver cannot access the delivery address, the number registered with the order will be contacted. If the customer does not answer after one attempt or the contact number is incorrect, the order will be returned to the Pancake Pleasures kitchen and a re-delivery fee of what was charged will apply or the customer must now pickup their order with no refund on the initial delivery charge.
If the delivery address supplied by the customer is incorrect or insufficient details are provided, Pancake Pleasures does not accept any responsibility for any incorrect deliveries. It is the obligation of the customer to supply accurate information when processing the order.
If a company name is not stated on the order and it is going to a company, the item is at risk of being incorrectly delivered. Pancake Pleasures will not take any responsibility for this as it is the customers responsibility to ensure sufficient delivery details are provided.
Please note: By choosing to deliver to businesses/schools, you inherit the risk of it not being delivered after the opening times and before the closing times. Pancake Pleasures does not recommend sending to any location that will not be available after 4pm.
PANCAKE DESIGN AND STORAGE
We reserve the right to substitute any decorations on our cakes, subject to stock availability. All pancakes are handmade which means slight imperfections and variations can occur. Please note, the proportion of the decorations may change on different sized boxes/pancake cakes and as what is shown in the photos.
All pancakes purchased from Pancake Pleasures are best consumed on the day of delivery/pickup as they are made fresh for every order. The pancakes are best consumed when stored in a cool, dry place. If you refrigerate your pancakes, this will cause the pancakes to harden and dry out.
All pancakes have a shelf life of 2 days from delivery/pickup and should be consumed within 48 hours of receiving them. When not being eaten keep them in an airtight container and in a cool, dry place. Pancake Pleasures under no circumstances recommends the pancakes to be refrigerated.
Pancake Pleasures cannot take any responsibility for any damages of pancake boxes/cakes that have been delivered successfully by our delivery partners. Any damages that have been caused when handling or transporting the cake are at the fault of the customer and will not be refunded/credited.
MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
PERSONAL INFORMATION
Your submission of personal information through the store is governed by our Privacy Policy.
ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia.
